1. Who we are

AgileBOQ (www.agileboq.com) is made and run by Agile QS Academy (Samuel Niyokwizerwa), "we" and "us" below. By creating an account, opening a project link we send you, or paying an invoice, you agree to these terms. If you use AgileBOQ for a company, you agree for that company.

2. What AgileBOQ is, and is not

• AgileBOQ is a tool that builds a model from drawings and calculates quantities, bills of quantities, bar schedules and valuations from it.
• Quantities depend on the drawings, the scale and the information you or we enter. Drawings can be wrong, incomplete or change. Every quantity, rate and total is an estimate that a competent person must check before it is used to price, tender, order materials, certify payment or build.
• Rates and prices shown in AgileBOQ are indicative examples. Check them for your market and date.
• AgileBOQ is not a substitute for a structural engineer, an architect or a registered quantity surveyor's professional judgement, and it does not check whether a design is safe or meets building rules.

3. Your account

Keep your password private and tell us at once if you think someone else is using your account. You are responsible for what happens in your account. Give a real email address so we can reach you about payments and projects.

4. Paying per project

• Modelling and viewing quantities is free. Reports (Excel, PDF and CSV exports and copies) are paid per project. The price depends on the number of drawing pages, floors and reports, as shown before you pay. The first invoice of a project has a minimum price.
• You pay by mobile money (MTN MoMo, Airtel Money, M-Pesa) or by card through Selar, then send the transaction ID or order ID. We unlock the reports when we see the money arrive, normally within one working day.
• If you add pages, floors or reports later, you pay only for what you added.
• Refunds: if we cannot unlock a project you paid for within 7 days, or you paid twice by mistake, we refund you in full. Once reports are unlocked we don't refund them, because they are delivered at once. Contact us if something is wrong and we will try to put it right.
• Prices are in the currency shown on the invoice. Any fees charged by your mobile money provider, bank or Selar are yours.

5. Projects we measure for you

• When you send drawings, we may quote a price to measure them. If you accept, we measure the project and send you a private view-only link with the invoice.
• You can check the model and quantities through the link before you pay. After payment is confirmed the same link gives full access: downloads and an editable copy.
• Tell us about mistakes within 14 days of payment and we correct them at no cost. Changes caused by new or revised drawings are a new job.
• The view-only link is for you and your team. Don't publish it.

6. Your drawings and data

• You keep all rights to the drawings, files and projects you upload. You confirm you are allowed to share them with us.
• You let us store and process them only to run AgileBOQ for you: to build models, calculate quantities, produce reports and support you. If you use Automate BOQ, pages of your drawings are sent to the AI provider we use for that purpose only.
• We don't sell your data and we don't show your projects to anyone you haven't shared them with. More detail is in our privacy notice.
• Keep your own copies of important files. We back up the service, but we can't promise that data will never be lost.

7. Our software

AgileBOQ, its code, design, templates, calculation methods and content belong to us. You may use it under these terms, and you may use the reports you paid for in your own work and give them to your clients. You may not copy, resell, rent or rebuild AgileBOQ, take its code, or try to get round the payment, export or access limits.

8. Fair use

Don't use AgileBOQ to break the law, upload harmful files, overload or attack the service, scrape it, or share an account with people outside your organisation. We may suspend an account that does, and we will tell you why.

9. Limits of our liability

• We do our best to make AgileBOQ accurate and reliable, but we provide it "as is". We don't promise it will be free of errors or fit for every purpose.
• We are not liable for decisions made, prices tendered, materials ordered or works built using AgileBOQ's quantities or reports without your own professional check (see section 2).
• We are not liable for indirect or consequential loss, such as lost profit, lost contracts, delay or damage to reputation.
• Our total liability to you for any claim about a project is limited to the amount you paid us for that project. For anything else, it is limited to the amount you paid us in the 12 months before the claim.
• Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud, or for death or injury caused by negligence.

10. Availability and changes

AgileBOQ runs on outside services (web hosting, database, payment and AI providers) and may sometimes be unavailable or slow. We improve the software often, and features may change. If we change these terms, we show the new date at the top of this page; important changes are announced in the app. Using AgileBOQ after a change means you accept it.

11. Ending the agreement

You can stop using AgileBOQ at any time and ask us to delete your account and projects. We may close accounts that break these terms. Sections 6, 7 and 9 continue after the agreement ends.
